Funeral home and morgue negligence can arise in hospitals leading to medical malpracticeFuneral homes and morgues in health care facilities have a special and heightened obligation to the surviving family to treat the remains of the deceased with dignity and all due respect. It is unfortunate and seemingly distasteful to sue a funeral home but the severe emotional damage that can be done will prevent future mistakes by the same or other funeral homes in acting in a cavalier and uncaring manner and perhaps put them on notice that the treatment of the remains of a loved one is important.

There have been many reported cases of malpractice across the nation involving funeral homes and morgues.  The body must be kept refrigerated and kept from decaying.   Regardless whether the viewing is going to be open casket or closed the surviving family often sees the body before burial and it must be managed in a way that preserves decorum and respect.
