Emergency medicine negligence is a fertile area for negligence because it is through the emergency room that patients with new problems oftentimes present in need of accurate diagnoses so they might receive correct and safe care.

Obviously the need for correct diagnoses is paramount because it is the diagnosis that dictates the care the individual will receive once admitted to the hospital. Alternatively, no diagnosis might be made and the patient discharged from the emergency room only to suffer catastrophic injury because the correct diagnosis was not made.

Sometimes the reluctance to order required tests or to have diagnostic tests properly interpreted leads to an incorrect diagnosis. Sometimes it is the overwhelmed emergency room, perhaps because of improper staffing levels or inadequately qualified physicians, which leads to delayed and incorrect diagnosis.
